RISE Terms of Service

Welcome to R.I.S.E., an app by Lambda Service Corp ("RISE," "R.I.S.E.," "we," "our," "us").

These Terms of Service ("Terms") govern your access to and use of the RISE app, website, and related services (collectively, the "Service").

By using RISE, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old to use RISE. If you are under 18, you may use RISE only with the permission and supervision of a parent or guardian.

2. Account Registration

You may need to create an account to use certain features. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Notify us immediately of any unauthorized use

3. Acceptable Use

You agree NOT to:

  • Use RISE for any illegal or harmful purpose
  • Harass, abuse, or harm others
  • Upload malicious code, viruses, or spam
  • Reverse-engineer or attempt to extract source code
  • Scrape data or use automated tools without permission

4. Wellness Disclaimer

RISE is a wellness and personal development tool. It is NOT:

  • A substitute for professional medical, mental health, or therapeutic services
  • Intended to diagnose, treat, cure, or prevent any condition

If you are in crisis or experiencing an emergency, please contact emergency services or a qualified mental health professional immediately.

5. Intellectual Property

All content, features, and functionality of RISE (including but not limited to text, graphics, logos, AI models, and software) are owned by Lambda Service Corp or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use RISE for personal, non-commercial purposes.

6. User-Generated Content

You retain ownership of any content you create (e.g., journal entries, reflections). By using RISE, you grant us a limited license to process and store your content solely for the purpose of providing the Service.

We do not use your personal content to train public AI models.

7. Privacy

Your use of RISE is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

8. Subscriptions and Payments

Some features may require a paid subscription. By subscribing, you agree to:

  • Pay all fees associated with your subscription
  • Automatic renewal unless you cancel
  • Cancellation does not entitle you to a refund for the current billing period

Refunds are handled on a case-by-case basis and are subject to our discretion.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of RISE at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

10. Termination

We may terminate or suspend your access to RISE at any time, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Any reason at our sole discretion

Upon termination, your right to use RISE ceases immediately.

11. Disclaimers

RISE is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content

12. Limitation of Liability

To the fullest extent permitted by law, Lambda Service Corp and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of RISE, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless Lambda Service Corp from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of RISE or violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of RISE will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You waive any right to a jury trial or to participate in a class action lawsuit.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app.

Your continued use of RISE after changes take effect constitutes acceptance of the updated Terms.
